1. Acceptance of Terms
By downloading or using AquaPerfect (“the App”), you agree to these Terms of Service. If you do not agree, you may not use the App.
2. Use of the App
- The App is provided solely for personal, non-commercial use.
- You agree not to misuse the App, attempt unauthorized access, or use it in ways that violate applicable laws or regulations.
- You are responsible for any content you submit through the App (e.g., photos and videos).
3. Media Processing
- The App allows you to select photos and videos for modification.
- Media processing occurs locally on your device. The App does not upload your selected media to our servers or to third-party AI services for core functionality.
- We do not retain your photos or videos on backend systems.
- You grant us a limited, temporary license to process your media solely for the purpose of providing the App’s functionality.
4. Intellectual Property
All rights, title, and interest in the App, including its design, code, and branding, remain with the developer. You may not copy, modify, distribute, or create derivative works of the App without prior written permission.
5. Disclaimer of Warranties
The App is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the App will be error-free, uninterrupted, or that results will meet your expectations.
6. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
- Our total liability for any claim related to the App will not exceed the amount you paid (if any) to download or use the App.
7. Third-Party Services
Core media processing functionality does not rely on third-party AI services. If the App links to or integrates optional third-party services in other contexts, we are not responsible for their acts or omissions.
8. Termination
We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms.
9. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in San Diego County, California.
10. Changes to These Terms
We may update these Terms from time to time. Changes will be effective when posted in the App or on our website. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
